Terms and Conditions

1. Subject

This agreement sets out the rights and obligations of the parties concerning the online sale of products offered on ArtRegalia.com. By using the site and placing an order, the customer acknowledges acceptance of these terms.

The personal data provided by the customer will be processed in accordance with applicable data protection laws.

4. Products, Stock Status, and Information  

 Products offered for sale are subject to availability and are presented with accurate information to the best of our efforts. If a product is found to be unavailable after an order is placed, Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. reserves the right to cancel the order. In such cases, the customer will be informed, and a full refund will be issued promptly. If the customer wishes, an equivalent product at the regular sale price may be offered. Choosing an alternative product implies the customer's acceptance of paying the full regular price, excluding any promotional discount. The company commits to informing the customer of such options and any additional costs before proceeding with order changes. If a product is unavailable, the customer may either wait for availability or request a refund.

5. Product Photos

 Product photos presented on ArtRegalia.com are for informational purposes only and are not contractually binding. They are intended to give customers a general idea of the product. Due to the handcrafted nature of some items, slight variations may occur between the delivered product and the photos shown on the website. Such differences do not indicate a defect if the product's functionality and intended use are not affected. Colors displayed on screens may differ from actual product colors due to screen settings. In such cases, the customer retains the right to return the product.

6. Customized Products  

In cases of personalized products (such as name embroidery, special design), if an error originates from the company, return shipping and correction costs are borne by the company. If the error is due to customer input, the customer is responsible for all costs associated with corrections and returns. A maximum of three design revisions is allowed free of charge; additional revisions may incur extra charges.

7. Special Orders

I Products marked as "Special Order" may require longer delivery times than standard products. Special order products will be delivered within a maximum of 30 business days from order confirmation. If the order includes both standard and special order products ("Mixed Orders"), deliveries may occur separately and at different times. The customer will be informed upon each shipment. The customer retains the right to withdraw from the contract within 30 business days following receipt of the products.

8. Discounted Products  

Products sold at a discount or marked as "clearance" on ArtRegalia.com are offered at reduced prices due to promotions or clearance sales. Such products are considered final sale items and are non-refundable and non-exchangeable. Since returns or exchanges are not accepted after order confirmation, customers are strongly advised to carefully review their choices before purchasing. This policy is designed to encourage responsible shopping and ensure customers benefit from the best available offers. Discount codes cannot be combined.

9. Prices and Taxes

All product prices do not include VAT unless otherwise stated. Local customs duties, import taxes, and any administrative fees that may arise after delivery are not included in the listed price for deliveries outside of Türkiye. The payment of such duties and taxes is the sole responsibility of the customer. 10. Order Completion  

 An order is considered complete only when payment has been successfully processed. Once the payment is confirmed, the customer will receive an order confirmation email.

11. Payment Methods

Payment must be made at the time of order placement. Payments can be made via credit card or bank transfer. Secure payment systems are used to ensure the confidentiality of your transactions. For payments made from Türkiye, bank fees may apply. Such fees can be covered by Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. upon request and subject to acceptance.For refund requests, please contact [returns@artregalia.com]. For payments made from outside Türkiye, all bank fees must be borne by the sender.

International Bank Transfers

In international money transfers, the "OUR" option must be selected for bank charges. After completing the payment, the SWIFT confirmation document must be obtained and sent to payment@artregalia.com as proof of payment. Bank payment orders or payment receipts are not accepted as valid proof of payment. Providing the SWIFT document is mandatory.

12. Delivery  

Products are delivered to the address provided by the customer at the time of ordering within 30 business days. Delivery times are indicative only; Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. shall not be held liable for any delivery delays. No deliveries are made on Saturdays, Sundays, or public holidays. The risk of loss or damage to the products passes to the customer at the moment of delivery. If the customer specifies an alternative delivery point during ordering, ownership transfers upon delivery, even if the product is not received in person. In case of delays, the customer will be informed and alternative solutions will be offered. Worldwide shipping is available. Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. shall not be responsible for any delivery delays or additional costs arising from the consignment being held at the customs of the import country.

13. Right of Withdrawal and Return Policy

Order cancellations are accepted only if notified to Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. within fourteen (14) business days from the receipt of the goods. We only replace items if they are defective or damaged. If you need to exchange your item for the same product, please email us at returns@artregalia.com for further instructions. If the returned item shows usage or damage beyond normal inspection, the corresponding depreciation will be deducted from the refund amount. To be eligible for a return, your item must be unused, in its original condition, and in its original packaging. Cancellation notices can be made by whatsapp or email returns@artregalia.com. The cancellation notice must include the order number, customer’s full name, and delivery address. Once the cancellation notice is received, the company will confirm the cancellation by telephone or email. Do not send any products back without obtaining authorization from our customer support. Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. reserves the right, at its sole discretion, to refuse returns that do not meet the return conditions stated above. Refunds will be issued within thirty (30) days from the confirmation of cancellation and receipt of returned goods.

If you have not received your refund:

1. Please check your bank account again.
2. Contact your credit card company – it may take some time before your refund is officially posted.
3. Contact your bank – there is often some processing time before a refund is posted.
4. If you have done all of the above and still have not received your refund, please contact us at returns@artregalia.com.

Products Not Eligible for Return Without Reason:

• Customized or personalized products: These products cannot be returned. However, if your customized item arrives damaged or defective, we will replace it.
• Products whose packaging has been opened for health or hygiene reasons
• Discounted or clearance items
• Gifted items

In case of cancellation, the direct return shipping costs are the customer's responsibility. In customer-initiated returns, return shipping fees are borne by the customer; in company-error returns, Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. will cover the return shipping costs. The return of goods is the customer's responsibility and must be made to the address we will provide. To minimize the risk of loss or damage during return shipping, we strongly recommend using a trackable delivery service. If you are returning an item worth over $70, we highly recommend purchasing shipping insurance. We cannot guarantee that we will receive your returned item. 14. Warranty  

Products are covered by the legal warranty applicable under the relevant laws. Defective products will be repaired, replaced, or refunded.

15. User Account   

The customer is responsible for maintaining the confidentiality of their account and password. The customer accepts full responsibility for all activities that occur under their account.

16. Typographical Errors and Information Updates

ArtRegalia.com makes every effort to ensure that product descriptions, prices, and other information are accurate and up-to-date. However, typographical errors, omissions, or inaccuracies may occur. We cannot guarantee that all information is always entirely accurate, complete, or current. If a typographical error or omission affecting a product's description or price is discovered, Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. reserves the right to refuse or cancel any orders placed for that product. If the customer has already been charged, a full refund will be issued using the original payment method. Upon identifying any errors, we strive to correct them promptly. 17. Communication 

By placing an order or registering on our website, the customer agrees to receive electronic communications from us. Customers may opt-out of promotional emails at any time.

18. Discount Codes and Vouchers

Discount codes can only be used for a single order and cannot be combined with other promotions. They have no cash value and cannot be exchanged for money. In case of returns, the discount will be proportionally deducted from the refund amount.  

19. Third-Party Websites  

Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. is not responsible for the content, services, or products offered by third-party websites that may be linked to from our site.

20. Limitation of Liability

Our liability to the customer is strictly limited to the value of the purchased goods. We shall not be responsible for any indirect or consequential loss, including but not limited to financial loss such as loss of profit, customs duties, customs clearance fees, or similar charges. This limitation does not apply to liability for death or personal injury caused by our negligence, or for any other liability which cannot be lawfully excluded.

21. Amendments to Terms and Conditions  

Kayla ve Atlas Sembolik Tekstil Dış Ticaret A.Ş. reserves the right to modify these Terms and Conditions of Sale at any time. Changes will become effective immediately upon their publication on ArtRegalia.com.

22. Governing Law and Jurisdiction  

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye. The courts and enforcement offices of Antalya shall have exclusive jurisdiction over any disputes arising from these Terms.
